1. Terms of Service
1.1 Agreement to Terms
By accessing or using LinqOptima ("the Service"), operated by LinqOptima ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
1.2 Description of Service
LinqOptima is an AI-powered platform that helps job seekers optimize their professional presence. Our services include:
- AI-generated professional headshots
- LinkedIn profile optimization (headlines, summaries, experience bullets)
- ATS-optimized CV/resume generation
- Tailored cover letter generation
- Skills recommendations for your industry
1.3 Eligibility
You must be at least 18 years old to use this Service. By using LinqOptima, you represent and warrant that you meet this requirement.
1.4 Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
1.5 Payment Terms
LinqOptima offers a one-time payment model. All payments are processed securely through Paddle.com, our Merchant of Record. By making a purchase, you also agree to Paddle's Checkout Buyer Terms.
Prices are displayed in USD. Applicable taxes (VAT, sales tax, etc.) are calculated and collected by Paddle based on your location.
1.6 Credits and Usage
Upon purchase, you receive a set number of credits for each service (headshots, profile optimizations, CV generations, cover letters). Credits do not expire and can be used at any time. Additional credits can be purchased if needed.
1.7 Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Impersonate any person or entity
- Upload photos of anyone other than yourself without their consent
- Attempt to reverse engineer, decompile, or extract the AI models
- Use automated systems to access the Service without our permission
- Resell or redistribute generated content for commercial purposes
1.8 Intellectual Property
Your Content: You retain ownership of any content you upload (photos, resume text, etc.). By uploading content, you grant us a limited license to process it for the purpose of providing our services.
Generated Content: Content generated by our AI (headshots, optimized text, CVs, cover letters) is licensed to you for personal and professional use, including on LinkedIn and job applications.
Our Platform: The LinqOptima platform, including its design, code, and AI models, remains our exclusive property.
1.9 AI-Generated Content Disclaimer
Our Service uses artificial intelligence to generate content. While we strive for high quality:
- AI-generated headshots are artistic interpretations and may not perfectly match your appearance
- Generated text should be reviewed and may require editing before use
- We do not guarantee specific job search outcomes or interview rates
- You are responsible for verifying the accuracy of any generated content before using it
1.10 Limitation of Liability
To the maximum extent permitted by law, LinqOptima shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
1.11 Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when possible.
1.12 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
1.13 Governing Law
These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Spain, except where consumer protection laws provide otherwise.
2. Privacy Policy
2.1 Information We Collect
Account Information: Email address, name (optional), and password when you create an account.
Profile Data: Professional information you provide, including work experience, education, skills, and career goals.
Photos: Selfies or photos you upload for AI headshot generation.
Usage Data: Information about how you interact with our Service, including pages visited and features used.
Payment Data: Processed securely by Paddle. We do not store your full payment card details.
2.2 How We Use Your Information
We use your information to:
- Provide and improve our AI-powered services
- Generate personalized headshots, profiles, CVs, and cover letters
- Process payments and prevent fraud
- Send service-related communications
- Respond to your inquiries and support requests
- Comply with legal obligations
2.3 Photo Handling
Important: Photos you upload are processed by our AI systems to generate headshots. Original uploaded photos are deleted from our systems within 24 hours of processing. Generated headshots are stored in your account until you delete them or your account is closed.
2.4 Data Sharing
We do not sell your personal information. We may share data with:
- Service Providers: Including Stripe (payments), Google Cloud (AI processing), and Hetzner (hosting and database)
- Legal Requirements: When required by law or to protect our rights
2.5 Data Security
We implement industry-standard security measures including:
- SSL/TLS encryption for all data in transit
- Encrypted database storage
- Secure authentication with hashed passwords
- Regular security audits
2.6 Your Rights (GDPR/CCPA)
Depending on your location, you may have rights to:
- Access: Request a copy of your personal data
- Rectification: Correct inaccurate personal data
- Erasure: Request deletion of your personal data
- Portability: Receive your data in a portable format
- Object: Object to certain processing of your data

2.7 Cookies
We use essential cookies for authentication and session management. We do not use third-party advertising or tracking cookies.
2.8 Data Retention
We retain your account data for as long as your account is active. You can request account deletion at any time. Upon deletion, we remove your personal data within 30 days, except where retention is required by law.
2.9 International Transfers
Your data may be processed in countries outside your residence, including the United States. We ensure appropriate safeguards are in place for such transfers.
2.10 Children's Privacy
Our Service is not directed to children under 18. We do not knowingly collect personal information from children. If you believe we have collected such information, please contact us immediately.
3. Refund Policy
3.1 Digital Content Notice
LinqOptima provides digital content and AI-generated services that are delivered immediately upon use. Once you generate content (headshots, profile optimizations, CVs, or cover letters), that content has been delivered to you and the service has been performed.
Your purchase includes the following credits:
- 5 AI professional headshot generations
- 5 LinkedIn profile optimizations
- 5 CV/resume generations
- 5 cover letter generations
Each time you use a feature, one credit is consumed. Your remaining credits are displayed in the app.
3.2 Refund Eligibility
We offer refunds within 30 days of purchase under the following conditions:
Full Refund
If you have not used any credits (no content generated), you are eligible for a full refund within 30 days of purchase.
Partial Refund
If you have used some credits, we may offer a partial refund proportional to your unused credits, at our discretion. This applies only if there are technical issues or the service did not perform as described.
No Refund
Once you have used all or most of your credits, refunds are not available as the digital service has been fully delivered.
3.3 Technical Issues
If you experience technical problems that prevent you from using the Service (e.g., generation failures, account access issues), please contact us. We will either resolve the issue or provide a refund as appropriate.
3.4 How to Request a Refund
To request a refund, contact us at [email protected] with your order confirmation or the email address used for purchase. Please include the reason for your refund request.
3.5 Refund Processing
Refunds are processed by Paddle, our payment provider. Once approved:
- Refunds are typically processed within 5-10 business days
- The refund will be credited to your original payment method
- Your access to paid features will be revoked upon refund
3.6 EU/UK Consumer Rights
If you are a consumer in the EU or UK, you have a 14-day statutory right of withdrawal for digital content purchases. However, by using our Service to generate content, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the digital content has been delivered. This is in accordance with Article 16(m) of the Consumer Rights Directive 2011/83/EU.
3.7 Abuse Prevention
We reserve the right to refuse refund requests where we identify patterns of abuse, including but not limited to: repeated purchases and refund requests, using the service extensively before requesting a refund, or any fraudulent activity. This does not affect your statutory rights for products that are faulty or not as described.
3.8 Disputes
If your refund request is denied and you believe this is incorrect, you may contact us again at [email protected] to discuss further. For EU consumers, you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We aim to resolve all complaints within 14 business days.
